CUSTOMER SERVICE

Shipping & Delivery

General:

Ultimate Performance and Design does not take responsibility for any typographical errors or accidental omissions. Prices and availability are subject to change without notice. Notification of changes will be given prior to shipping. Prices do not include shipping charges. All orders placed in Texas are subject to the state sales tax.

Ordering:

Orders may be placed by mail or fax. Please include full name, daytime phone number, billing address, shipping address (if different) and method of payment. UPS will not ship to PO, APO, or FPO Boxes. Orders to these addresses will be sent USPS. Phone Orders: Phone orders may be placed Monday through Friday 9:00 am to 5:00 pm. All credit card orders require verification through billing addresses. Please supply vehicle information including year, make, model, and engine size.

Payment:

Ultimate Performance and Design accepts Master Card, Visa, Discover, American Express and PayPal. All COD orders will be sent cashier’s check or money order only.

Shipment:

All orders are sent F.O.B. shipping point Stafford, Texas. All items are sent by UPS ground or USPS priority mail. Next or Second Day Air and Third Day Select shipping are available for an additional charge. Any orders over 150 pounds are shipped via truck

Back Orders:

Any orders, which cannot be filled immediately, are considered to be on back order. Every attempt is made to ship within a reasonable time up to 7-10 working days. Notification will be given if any product is expected to be on back order for any longer period of time.

Returns & Replacements

Returns:

All items to be returned must be approved in advance and issued a Return Goods Authorization (RGA) number. Returns will not be accepted without RGA number and will be return to customer at their expense. No returns after 30 days. Shipping and handling charges will not be refunded and restock charges may be applied.

Warranty:

Customers are obligated to inspect delivered goods immediately upon receipt and to give written and verbal notice of a defect immediately. No claims for damage will be honored 5 or more business days after receipt. All claims of defects in workmanship must be made during this same period. Ultimate Performance warrants that all Ultimate Performance products are free from defects in material and workmanship. Due to the variety of modifications and changes made to vehicles that may affect the performance or durability of related components, Ultimate Performance’s obligation under this warranty extends only to the repair or replacement parts manufactured or sold by Ultimate Performance and not for labor. To file a warranty claim, parts must be returned with proof of purchase, the customer name and address, type of car, year, engine number, and odometer reading. No claims will be considered without valid proof of purchase and all documentation and the original Ultimate Performance part. Return freight charges must be prepaid. Collect returns will not be accepted. All parts replaced under warranty may become the property of Ultimate Performance

Exclusions:

Parts showing evidence of misapplication, abuse, improper maintenance, improper installation or alterations from their original configuration, or failure to follow installation instructions are expressly not covered by this warranty. Ultimate Performance also reserves the right to make changes to products, or specifications at any time without obligation to modify earlier parts. No person, company, or other organization is authorized to assume for Ultimate Performance any warranty responsibility or make binding judgments regarding warranties of any parts, which from time to time may become subject of a warranty claim. Ultimate Performance’s limited product warranty specifically excludes: - Shipping charges, towing and rental car charges, damage to a component or assembly due to installation of replacement parts with specifications that differ in any material respect from the original vehicle manufacturer’s or Ultimate Performance’s parts. - Damage resulting from the unauthorized modification of an Ultimate Performance part, damage resulting from the use of other manufacturer’s products in conjunction with an Ultimate Performance product - Damage attributed to negligence, improper installation, improper treatment contrary to the instructions in the owner’s manual from the original vehicle manufacturer or Ultimate Performance’s product instructions.

Limitations of liability

Ultimate Performance will not be held liable for any damage caused by the use of Ultimate Performance products, either directly or indirectly. Ultimate Performance makes no claims as to emission performance for street or highway use. Some equipment is not sold for street use in any state or country where state or federal regulations prohibit its use. Ultimate Performance makes no claims as to fitness of purpose for any product.
